ENFORCEMENT
Enforcement
Enforcement of IP rights should be understood as taking actions to protect the IP rights. Owners of IP rights can take legal actions when an infringement of IP rights occurs, when others unlawfully use the IPR belonging to another organization or individual. Examples of this include the unauthorized manufacturing of patented technology; the sale of counterfeit products; similar goods bearing another company's trademark; distribution of music or film without the copyright owner's consent (pirated goods).
In case of a dispute with a user of your work, your invention, your trademark, your design etc. and if there is no possibility to resolve the dispute in an amical way, then you need to enforce your intellectual property rights and with the assistance of a lawyer take some action by using enforcement procedures. Enforcement provisions found in Kosovo’s national legislation may be divided into the following categories: civil remedies; criminal sanctions; administrative sanctions; border measures; and measures, remedies, and sanctions against abuses in respect of technical devices.
